28 GM workers can proceed with suit against automaker, UAW

A federal judge says 28 workers at General Motors’ Lordstown, Ohio, assembly plant can proceed with their lawsuit against the automaker, the UAW and UAW Local 1112 alleging that the workers were wrongly classified as temporary employees and were improperly terminated in 2007, according to wire service and newspaper reports.

Judge Benita Pearson of the U.S. District Court in the Northern District of Ohio on Saturday denied the defendants’ motion for a summary judgment, meaning the case will continue, according to TribToday.com, an online newspaper in Warren, Ohio.

The workers, seeking back pay of $3 million to $4 million, said their pay was cut by more than 40 percent once they were rehired after losing their jobs, the Associated Press reported.

The workers filed the suit in April. GM and the union denied the allegations in court documents, according to AP.

The plant makes the Chevrolet Cruze.
